How Probate Works
Depending upon the circumstances, probate can prove to be a relatively easy process. The executor/personal representative of the estate, as named in the will, is charged with several tasks, including:
- Gathering and distributing assets
- Filing the necessary documentation with the probate court
- Ensuring payment of the deceased's outstanding debts
- Ensuring payment of the deceased's estate taxes
Please note, not all assets are subject to the probate process, including bank accounts with payable on death provisions, life insurance policies with designated beneficiaries, and real estate jointly owned by the deceased and another party. Furthermore, if your loved one has left no will (died intestate) his or her assets will be divided among family members in accordance with Florida law.
